DEPOSIT and SALE CONTRACT: Shurdan Creek Aussies *This DEPOSIT CONTRACT (hereinafter CONTRACT) is effective when signed below by both Seller and Buyer (whether singular or plural). *The following terms and conditions are agreed to between Seller and Buyer: *When a reservation for a dog is placed, a $200 deposit of the puppy price is required and is non-refundable. *Balance will be due before possession of the puppy by the Buyer. *The Seller reserves the right to cancel this contract, in which the deposit will be refunded in full. *Puppies will not be released to new homes until the age of 8 weeks. *Puppies being shipped via airline will be charged for purchase of crate, health certificate, flight arrangements and transportation to airport. *Flight costs will be paid by buyer according to the current fees. *Puppies being shipped via airlines will be shipped no earlier than 8 weeks of age. *If deposit is made on puppy before puppy is of age to ship then Buyer has 4 weeks from the date the puppy is available to ship to make final payment for puppy and shipping costs. A fee of $10.00 a week will be assessed after puppy is 9 weeks of age. *If deposit is made on puppy after puppy is of age to ship then Buyer has 4 weeks from deposit date to make final payment for puppy and shipping costs. *Buyer will also be charged for additional vaccinations and veterinary costs if needed after 9 weeks of age. *Puppies are sold with Full Registration Papers for show/breeding or Limited Registration for pet/companion. *Payment Policy: Personal checks are ONLY accepted for deposits (as long as they have time to clear before picking up puppy); upon pickup we accept CASH ONLY and a receipt can be provided upon request. We can accept credit cards thru PayPal. Said puppy is deemed healthy and free of any infectious diseases for 72 hours after receipt of puppy. After that
time, no health provisions are made with the exception of Canine Hip Dysplasia, Cataracts and Idiopathic Epilepsy.
It is agreed that the owner, at the owner’s expenses have the puppy examined by their local veterinarian within
seventy-two hours of purchase.
If puppy dies within 7 days, in order to receive a replacement puppy, the. Buyer
MUST have a necropsy completed including a FULL blood panel and send samples to state lab for testing. A report
must be provided to the breeder within 39 days of the necropsy being performed. ALL expenses are to be paid for
by the buyer, If the necropsy report determines the puppy died from an accident, toxin or by abuse or neglect, NO
replacement puppy will be granted!! The contract will be void and null…
Hips and elbows are to be guaranteed to be free of canine hip/elbow dysplasia
for a period of 30 months from birth date of said puppy. If during this period, hip/elbow dysplasia is suspected
puppy will be immediately radio graphed (x-rayed) by a licensed orthopedic veterinarian and all x-rays will be
submitted to the OFA (Orthopedic Foundation for Animals) for evaluation. Such medical expenses shall be paid by
the buyer. Upon final diagnosis of hip/elbow dysplasia, the breeder shall have the option of providing a replacement
puppy at a later date (with in 2 years or 24 months). Such remedy shall be the sole remedy available to the owner
herein. It is understood that a replacement puppy will carry its own contract with the same terms and agreement and
guarantee: that a replacement puppy will be provided only when the original puppy is deceased or returned; and that
a replacement puppy will be dependent upon availability. It is also understood that a replacement puppy does not
include shipping, health certificate or crate costs.
Said puppy is guaranteed against cataracts*, Hip/elbow dysplasia*, Idiopathic
Epilepsy*(IE) & Monorchid or Cryptochid (1 or no testicles) (show homes only on testes).
a. Cataracts guarantee- a certified canine ophthalmologist MUST provide
Proof (CERF sheet/paper/Certificate) to buyer for buyer to copy and send to breeder within 30 months of age of
said puppy. Proof must also state likely hood of it being genetic.
b. Hip/Elbow guarantee above on item number 3.
c. If epilepsy is suspected buyer MUST do all available tests (including full blood panel, M.R.I. as these are
examples) to rule out every possible situation in order to make sure that it is inherited epilepsy (Idiopathic Epilepsy).
Seizures caused by toxins/trauma or any other form not genetically caused are NOT covered under this guarantee.
d. Monorchid or Cryptochid guarantee-(show home only) puppy should have BOTH (2) testicles by 12 months
of age, if 1 or no testicles are dropped by 12 months of age written certified Veterinarian proof should be given by
13 months of age.
At the time of sale, the puppy was well socialized and of sound temperament, since the breeder can not control the
environment, training or additional socialization after time of sale, no provisions are made in regards to temperament;
and it is the owners responsibility to further socialize and train said puppy. HOWEVER, if there is any question as to
the stability of the temperament of said puppy prior to the age 6 months, it maybe returned to the breeder for a
replacement puppy, conditional upon availability, provided the puppy is returned at buyers expenses and is returned
in good health. Proof must be provided from a behavioral trainer and puppy has been properly maintained. If
returned, no cash refund will be made under any condition. All registration papers will be signed back to breeder.
